This page serves to define our Terms and Conditions in a prominent and transparent manner, in plain English.    These Terms & Conditions  and are accessible from every page on our website from links shown at the bottom of each page which link to to this electronic document. 

 It is important that you read these Terms and Conditions carefully.  Together with our Privacy Policy, they govern our relationship with you in relation to this website and your purchase of goods from it.    We would stress our advice to you to keep a hard copy of these Terms and Conditions and your order details for your future reference. 

These Terms and Conditions first became current and effective as of 14th May 2018.  A review and verification of these Terms and Conditions  has been conducted  by ourselves, trading from the only Mullard Magic website and we hereby confirm they remain current and effective, and comply with current Distance Selling Legislation and post Brexit supply of Goods to the EU as of the 1st November 2022.

 

 HOW TO ORDER FROM MULLARD MAGIC

To be able to order you will need to register on this website - use the link at the top right of the home page and just follow the instructions and log in using your unique log-in details supplied as part of the registration process (e.g. username, password). You are responsible for keeping your log-in details confidential. You agree to accept responsibility for all activities which occur in relation to the same.  You must not permit other people to use your username or your password.

The Mullard Magic website can be found ONLY at the following web address:-

And will hereafter be referred to as "the only Mullard Magic website."

Any other websites purporting to be Mullard Magic but not at the above specified web address, mullard.org must be fraudulent scam sites.  Accordingly, we will not and cannot be held responsible for the consequences of any customer interaction with any website having a domain other than mullard.org

 You must contact us as soon as possible if you believe that anyone has obtained your log-in details without your permission or if you become aware of any other breach of security on t he only Mullard Magic website. We will not be held responsible to you if there is unauthorised access to your log-in details or unauthorised activity on the only Mullard Magic website as a result of your log-in details becoming known by someone else, unless this is due to our own failure to take proper care.

 By placing an order, you agree to be bound by these Terms and Conditions.  Again, we would stress our advice to you to keep a hard copy of these Terms and Conditions and your order details for your future reference.

 Once you have completed compiling your order, you will be asked to confirm that it is correct. If it is not correct, you can revisit your order and correct any mistakes before finally confirming and submitting your order to us.  It is your responsibility to ensure that your order is correct before submitting it to us. If you have any problems with your order, please contact us.

 When you submit your order, you are offering to buy the goods at the price set out in the order and in accordance with this and all the additional conditions listed below.

 

PAYMENT

All orders MUST BE pre-paid, we accept cash, major credit cards via Paypal, Pounds Sterling cheque supported by a valid banker’s card made payable to QP Holdings, International Money Orders drawn in GB Pounds Sterling and direct bank transfer.   Currently, overseas bank transfer is not offered as a payment method.  No payment will be deemed to have been made until we have cleared funds and we will not dispatch the goods until we receive payment in full. 

 

INTERNATIONAL ORDERS

The only Mullard Magic website and ourselves are geographically situated in Great Britain (United Kingdom, UK) but will supply physical goods internationally.  These will be shipped with the applicable customs declarations as specified by the purchaser's country.  The value of the customs declaration will be the monetary value paid for the supply of purchased goods plus the cost of carriage.

The only Mullard Magic website and ourselves are not VAT registered in the UK nor does it have any extant VAT registration within any EU Country.

International purchasers, by means of these Terms & Conditions are hereby made aware that they are responsible for the payment of any customs levy or duty payable or VAT liability as a consequence of their purchase.  Similarly, in the event of a product return, international purchasers are responsible for the re-claiming of any customs levy or duty paid or VAT liability as a consequence of the initial purchase.


EU VAT & CUSTOMS DUTIES

 

Due to a change in VAT requirements following Brexit and the ridiculous requirements of VerpackG, we will not supply or ship to the EU


THE SALE OF ALL GOODS VIA THE ONLY MULLARD MAGIC WEBSITE     


 All goods sold via the only Mullard Magic website are SOLD AS SEEN, SOLD AS SHOWN.  While we show photographs, provide approximate measurements, catalogues of goods, these items are for identification and reference only.  Purchasers must satisfy themselves that the goods meet their specification and requirements as to their condition, dimensions, part numbers and quality, before purchase, and we the the vendors give no warranty or guarantee express or implied for any item for its given or any other purpose.  

Pursuent to the above and applicable to the sale of all goods via the only Mullard Magic website, in accordance with  Consumer Contract Regulations (2014) and the Consumer Rights Act (2015), even if a purchaser has not conducted their verification of suitability, customer returns are allowed, however, no liability will be accepted by ourselves for carriage expenses ensued and the customer will be liable for all initial carriage and carriage return costs.

      

 

THE SALE OF ELECTRICAL GOODS VIA THE ONLY MULLARD MAGIC WEBSITE

An indication of working condition may be given in the item description, however, and only where expressly stated will the only Mullard Magic website and ourselves have conducted PAT or other form of electrical safety testing.  In such instances the testing will have been carried out using an instrument within calibration and calibrated and standardised against a NIST or UKAS traceable standard.

 Where PAT or other safety testing has not been conducted then any electrical item offered for sale will show in the description title, the notation " COLLECTOR’S ITEM, NOT FOR CONNECTION TO A MAINS POWER SUPPLY" and as such are exempt from General Product Safety Regulations (2005).   If a customer chooses to buy an item described as such then they automatically accept that the electrical item must  be inspected by a competent qualified electrician before any attempt to connect this item to a mains electrical supply and as purchaser, it is their responsibility to undertake this action.

 Where PAT or other safety testing has not been conducted then any electrical item offered for sale will NEVER be fitted with a plug top and any pre-sale fitment of a plug top, will be removed prior to shipment by cutting the flex.  A confirmatory hard copy statement of this condition, specific to the only Mullard Magic website order number will ALWAYS be included with a shipment to a customer and this action and warning serves to discharge our liability under the Consumer Rights Act (2015), unfair terms provision with respect to death and personal injury caused by the use of items sold by ourselves trading from the only Mullard Magic website for their intended or any other purpose and the Consumer Rights Act (2015), provisions for 'goods being of satisfactory  quality' and of 'goods being fit for purpose.'

 

 THE SALE OF AUDIO VALVES (TUBES) VIA THE ONLY MULLARD MAGIC WEBSITE

 All audio thermionic devices supplied by ourselves trading via the only Mullard Magic website will be tested before shipment unless otherwise stated.   Devices are tested using one of my three standardised & calibrated Avo Valve Characteristic Meters or my uTracer thermionic valve curve analyser.  The secondary calibrated artefact used to standardise these valve characteristic meters is traceable to a primary standard.   The obtained data may not be necessarily be identical to that obtained by a purchaser using their own test apparatus.

Thermionic devices are a consumable product having a finite lifespan in the range 2000 - 8000 hours.   Our thermionic devices are sold on this basis and are NOT supplied "on approval" whereby a customer will use them for a period and decide "they do not like the sound."    On this basis all sales are final - you use 'em they're yours! 

 

THE SALE OF GENERAL RADIO VALVES (TUBES) VIA THE ONLY MULLARD MAGIC WEBSITE

All general radio valves will be tested wherever specified or sold as New Old Stock, boxed (NOS) and although up to 85 years on are assumed to be unused.  These valves are subject to the naming convention as follows:-

eg.  D1, MULLARD, NEW BOXED,ARD2, CV1078 where the first, primary notation is the valve descriptor and where the second and all successive notations are listed equivalents for either IERC, service or common valve notations.

No liability can be accepted for any errors that occur in equivalent listings as these are gleaned from historical data tables.  A purchaser must verify that a particular valve ordered meets their particular requirements prior to submitting their order.  

 As a convenience, general radio valve listings include as part of the offering, a scan of the manufacturer's specification page which may or may not include a photograph of artist's illustration of the valve.  A purchaser must consider that the valve offered will not necessarily have the same form or appearance as the valve listed and if a particular shape or form is required by a customer then they must verify prior to ordering that the offering has the physical form they require.

DELIVERY & SHIPPING

 The only Mullard Magic website has been operational for over twenty years hence we have experience in shipping fragile and desirable collectable items to Worldwide locations. Delivery and shipping for all goods is arranged via a range of commercial courier services including the Royal Mail.    Purchasers must be aware that delivery is arranged on behalf of the purchaser to transport goods ordered from the only Mullard Magic website.  All goods will be shipped by an Insured and Trackable service such that in the event of loss or damage in transit, ourselves, trading via the only Mullard Magic website can comply with the requirements of the Consumer Rights Act 2015.

 

FORCE MAJEURE

 We will not be liable to you in the event that we are prevented by circumstances beyond our control from delivering any product which you have ordered or for any damaged or defective goods.

 We do our best to ensure that all goods shown on this website are available to order.  However, if any goods that you have ordered are out of stock or no longer available we will attempt to contact you to arrange a refund or alternative time for delivery.  In addition, if the goods are no longer available, in order to maintain customer satisfaction, we may offer you substituted goods of a similar nature and quality.   Again, should this be the case, we will contact you and ask if you wish to proceed.

 If you confirm that you do wish to proceed, please remember that we will still not be under an obligation to supply the goods until we have confirmed that we have accepted your order.  If you wish to exercise your right to cancel as set out below in respect of substituted goods, we will re-imburse the postal cost of you returning such items to us.

 

VALIDATION, JURESDICTION & DISCLAIMER

 If any only Mullard Magic website term, condition, or provision of these terms and conditions is determined to be unlawful, invalid, void, or for any reason unenforceable, the validity and enforceability of the remaining terms, conditions and provisions shall not in any way be affected or impaired thereby.

 Without prejudice to your statutory rights, the only Mullard Magic website and all information, text, names, images, pictures, logos, links and icons and other materials (without limitation) are provided 'AS IS' and on an 'IS AVAILABLE' basis without representation warranty or endorsement, express or implied.  Ourselves, trading via the only Mullard Magic website do not warrant or represent the accuracy or completeness of information provided on the site nor do we guarantee that use of this site will be uninterrupted or error-free, or that the site and its servers are free of computer viruses or bugs.

In no event will ourselves, trading from the only Mullard Magic website be liable to any person for any damage or loss that may arise from the use of any information contained in our site or the use of any products displayed on our website or any products purchased from our website, including, without limitation, indirect or consequential damages, or any damages whatsoever arising from use or loss of use, data, or profits, whether in action of contract, negligence or any other action, arising out of or in connection with the use of the only Mullard Magic website.

 Notwithstanding anything else in these Terms & Conditions, we will not be liable for claims relating to the functionality or availability of this site.

 These Terms & Conditions shall be governed by and construed in accordance with the laws of England, Scotland and Wales. Disputes arising here from shall be exclusively subject to the jurisdiction of the courts of England.

If any of these Terms should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these Terms are intended to be effective, it shall be severed and deleted from this clause. All other Terms of Use and Terms & Conditions shall remain in full force and continue to be binding and enforceable pursuant to the Contracts (Rights of Third Parties) Act 1999.

  

COPYRIGHT & OTHER RIGHTS

 All materials, including images (excepting those existing within the realm termed public domain) , illustrations, designs, site layout, photographs, written and other text or script that are part of this website together with all software compilations, underlying source code and software in the site are protected by copyright, trade mark, design right, and/or other worldwide intellectual property rights and are owned or controlled by or licensed to Mullard Magic. All rights are reserved.

 The contents of the ourselves, trading from the only Mullard Magic website  as a whole are intended solely for personal, non-commercial use.  Customers, users and viewers must not reproduce (except as noted above), publish, transmit, distribute, display, modify, create derivative works from or facsimiles of, sell, barter or participate in any sale of or conduct any exploitation in whatever form, in whole or in piecemeal or part, any of the contents, the website or any related software without our express prior written permission.

   

MULLARD MAGIC & THE WEEE DIRECTIVE

 The Waste Electrical and Electronic Equipment (WEEE) regulations have recently been introduced by the UK government in order to reduce the number of electrical items due to end of life disposal reaching landfill and encourage recycling and re-use of these products using the best available practices.    Electrical goods are currently the fastest growing waste stream within the UK, where over 75% of electrical goods are disposed of as landfill even though many of these goods may be economically repaired or recycled.   Ideally, residual WEEE should be disposed of in an environmentally sound manner.    When disposing of or recycling your old WEEE,  ourselves, trading from the only Mullard Magic website  respectfully request that you do so in accordance with local existing legislation which is available from your local authority or by reference to www.recycle-more.co.uk.
